Smart Money Club is operated by an independent sole trader (autónomo) based in Spain. These Terms are provided in English, which is the governing language of our agreement with you.

By using the Services you accept these Terms in full. We may update or modify these Terms at any time by posting a revised version on smartmoneyclub.us, with the "Last updated" date reflecting the change. Changes take effect when posted, and your continued use of the Services after any change constitutes your acceptance of the updated Terms. It is your responsibility to review this page periodically. If you do not agree with a change, you must stop using the Services.

You represent that you are at least 18 years of age (or the age of legal majority in your jurisdiction), that you have the legal capacity to enter into this agreement, and that you are legally permitted to access and use the Services and to trade or invest in the markets you choose. It is your sole responsibility to ensure that your use of the Services complies with all laws and regulations that apply to you. The Services are not directed to any person in any jurisdiction where their use would be contrary to law.

Subject to your compliance with these Terms and payment of the applicable fees, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the SMC indicators for your own individual use only. Access is delivered to your personal TradingView username on an invite-only basis and is tied to the individual account to which it is granted. Access is personal and non-transferable. This licence does not transfer any ownership rights to you and may be revoked if you breach these Terms.

You are responsible for providing the correct TradingView username and for keeping your access credentials secure. You may not share, lend, sell, or transfer your access to any other person or account. Each purchase grants access for one user only. We reserve the right to verify, suspend, or revoke access that appears to be shared, resold, or used in breach of these Terms, without refund.

You agree not to, and not to permit any third party to: copy, reproduce, share, resell, redistribute, sublicense, rent, lease, or publish the Services; reverse-engineer, decompile, disassemble, or attempt to derive the source code or logic of any indicator; circumvent access controls or licensing; use the Services for any unlawful, fraudulent, or abusive purpose; or use the Services in any way that could damage, disable, overburden, or impair them or interfere with any other user. Breach of this section is a material breach of these Terms and may result in immediate termination of access without refund.

All payments are processed securely by our third-party payment processor, Stripe; we do not see or store your full card details. Prices are displayed on the website and may change at any time, though changes do not affect purchases already completed. Subscription plans (such as Monthly and Quarterly) renew automatically at the then-current price until you cancel, and by purchasing a subscription you authorise recurring charges to your payment method until cancellation. You are responsible for any taxes that may apply to your purchase. If a payment fails, access may be suspended or revoked in accordance with our policies.

The Services are digital products delivered instantly upon successful payment. Because access is granted immediately, all sales are final and all payments are non-refundable, to the fullest extent permitted by applicable law, as set out in full in our Refund & Cancellation Policy. Where you are an EU or UK consumer, by purchasing you expressly request immediate access to digital content and acknowledge that you thereby lose any right of withdrawal or "cooling-off" period to the extent permitted by law. You may cancel a subscription at any time through your Stripe customer portal; cancellation stops future renewals but does not entitle you to a refund of amounts already paid, and access continues until the end of the period already paid for.

The Services are charting and educational tools only. They are not financial, investment, legal, or tax advice, not a signals service, and not an auto-trading system, and we do not execute trades or manage money on your behalf. Trading and investing involve a high level of risk and you may lose some or all of your capital. We make no guarantee of profit, performance, or results of any kind. The full terms of this section are set out in our Disclaimer, which forms part of these Terms. You are solely responsible for your own trading and investment decisions.

The SMC name, the "SMC." logo, the product names Order Block Detector™, AutoLiquidity™, TradingPlan™, Institutional VWAP Pro™, Forex Sessions™, and Liquidity Sweep™, together with all related text, graphics, code, designs, and content, are the property of Smart Money Club and are protected by intellectual-property laws. Nothing in these Terms transfers any of these rights to you. All third-party names, logos, and trademarks remain the property of their respective owners.

The Services rely on third-party platforms, in particular TradingView® and Stripe. SMC is independent and is not affiliated with, endorsed by, or sponsored by TradingView, Stripe, any broker, exchange, prop firm, or data provider. TradingView® is a registered trademark of TradingView, Inc., which has no affiliation with SMC and does not endorse or provide the Services. Your use of any third-party platform is governed by that third party's own terms, and we are not responsible for the acts, omissions, availability, or performance of any third party.

We may modify, suspend, or discontinue any part of the Services at any time, without notice and without liability. We may suspend or terminate your access immediately, without refund, if you breach these Terms, misuse the Services, initiate a bad-faith chargeback, or where required by law. You may stop using the Services at any time. Sections of these Terms that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnification, and governing law) will continue to apply.

The Services are provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, or statutory, to the maximum extent permitted by applicable law. We do not warrant that the Services will be available, uninterrupted, error-free, or free of inaccuracies, or that any indicator will function without fault. You use the Services at your own risk. Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law.

To the maximum extent permitted by applicable law, in no event shall Smart Money Club or its operator be liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or trading losses, arising out of or in connection with your access to, use of, or inability to use the Services, under any legal theory. Where liability cannot be excluded by law, it shall be limited to the total amount you actually paid to SMC for the Services in the twelve (12) months preceding the event giving rise to the claim. Nothing in these Terms limits liability for fraud, death, or personal injury caused by negligence, or any other liability that cannot be limited by law.

You agree to indemnify, defend, and hold harmless Smart Money Club and its operator from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to your use or misuse of the Services, your trading or investment decisions, your breach of these Terms, or your violation of any applicable law or the rights of any third party.

These Terms, and any dispute or claim arising out of or in connection with them, are governed by the laws of Spain, without prejudice to any mandatory consumer-protection rights you may have under the laws of your country of residence. If you are a consumer, you may be entitled to bring proceedings in the courts of your place of residence. Consumers resident in the EU may also use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr. If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be severed and the remaining provisions shall continue in full force and effect. These Terms, together with the Disclaimer, Privacy Policy, Refund & Cancellation Policy, and Cookie Policy, constitute the entire agreement between you and SMC regarding the Services and supersede any prior agreements. Our failure to enforce any right or provision is not a waiver of that right or provision.
