1. Educational Software Notice

Smart Money Club provides technical analysis software for the TradingView platform. Our indicators are visual analysis tools: they identify and display price action patterns — Order Blocks, Supply and Demand zones, liquidity levels, structural breaks, session ranges and volume-weighted averages — based on historical and live chart data.

Our products are supplied strictly for educational and analytical purposes. They are not a trading system, not a signal service, and not a managed account product. They do not place, modify or close trades, do not connect to any broker, and do not automate execution in any way.

Every trading decision made using our software is taken solely by the user, at the user's own discretion and risk.

2. Not Financial Advice

Smart Money Club is not a financial advisor, investment advisor, broker, broker-dealer, fund manager or financial institution, and does not hold itself out as any of these.

Nothing on this website, in our software, in our documentation, in our guides, or on any of our social media channels constitutes:

  • investment advice or a personal recommendation;
  • an offer, solicitation or inducement to buy or sell any financial instrument;
  • a suggestion that any strategy, market, instrument or approach is suitable for you;

4. No Performance Guarantee

Smart Money Club makes no guarantee, representation or warranty of any kind regarding trading results, profitability, accuracy or performance.

  • Past performance is not indicative of and does not guarantee future results.
  • No indicator, tool, method or strategy can predict future price movement.
  • The identification of a zone, level or pattern by our software does not mean price will react to it.
  • Results vary between users depending on discipline, risk management, market conditions, execution, broker, instrument and countless other factors outside our control.

Any charts, screenshots or examples shown on this website are illustrative of how the software displays information. They are not a promise, projection or forecast of results.

5. Hypothetical and Simulated Performance (CFTC Rule 4.41)

Hypothetical or simulated performance results have inherent limitations. Unlike an actual performance record, simulated results do not represent actual trading. Because the trades have not been executed, results may have under- or over-compensated for the impact, if any, of certain market factors such as lack of liquidity.

Our indicators operate exclusively within the TradingView platform. Their availability, functionality and performance therefore depend on TradingView's own infrastructure, data feeds, servers and terms of service, all of which are entirely outside our control.

Smart Money Club is not affiliated with, endorsed by, sponsored by or connected to TradingView Inc. in any way. TradingView is a registered trademark of its respective owner.

We accept no liability for interruptions, outages, data errors, delays, feed discrepancies, platform changes or discontinuation of service caused by TradingView or by any third party.

Chart data accuracy depends on the data provider and the broker feed selected by the user, and may differ between sources.

8. Third-Party Trademarks and No Affiliation

Smart Money Club is an independent product. We are not affiliated with, sponsored by, endorsed by or connected to FTMO, Topstep, Apex Trader Funding, The Funded Trader, MyForexFunds, Alpha Capital, or any other proprietary trading firm, broker, exchange or financial institution.

Any third-party names, logos or trademarks appearing on this website remain the property of their respective owners and are referenced solely for descriptive purposes, to indicate general software compatibility. Their appearance does not imply any partnership, approval, endorsement or relationship of any kind.

It is the user's sole responsibility to verify that the use of any third-party analysis tool complies with the rules, terms and conditions of their own broker or funding provider. Rules differ between firms and change over time. We make no representation that our software complies with the rules of any particular firm.

9. Software Provided "As Is"

Our software is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy or non-infringement.

We do not warrant that the software will be uninterrupted, error-free, free of defects, or that it will meet your specific requirements or expectations.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Smart Money Club shall not be liable for any direct, indirect, incidental, special, consequential, exemplary or punitive damages, including without limitation trading losses, loss of profits, loss of capital, loss of data, loss of opportunity, or business interruption, arising from or connected to:

  • the use of, or inability to use, our software;
  • any trading decision taken by the user;
  • any error, inaccuracy, delay or omission in the display of chart information;
  • any interruption or failure of TradingView or any third-party service;
  • reliance on any content published on this website or our social channels.

Nothing in this disclaimer excludes or limits liability where such exclusion or limitation is not permitted by applicable law, including liability for fraud or for death or personal injury caused by negligence.

11. User Responsibility

By purchasing or using our software, you confirm that:

  • you are at least 18 years old and legally able to enter into this agreement;
  • trading in your country of residence is lawful and permitted for you;
  • you are solely responsible for your own trading decisions and their consequences;
  • you understand you may lose money and accept that risk entirely;
  • you will not rely on our software as the sole basis for any financial decision;
  • you have read and understood this disclaimer in full.

12. Digital Product and Access

Our products are digital licences granting access to invite-only scripts on the TradingView platform. Access is delivered automatically to the TradingView username provided by the customer.

Because the product is delivered digitally and immediately, our refund terms are set out in our Refund Policy, which forms part of these terms.

It is the customer's responsibility to provide a correct TradingView username. Access granted to an incorrect username can be reassigned through our recovery page.

13. Intellectual Property

All indicators, source code, algorithms, documentation, guides, branding, trademarks, text, graphics and content published by Smart Money Club remain our exclusive intellectual property.

Purchasing a licence grants you a personal, non-transferable, non-exclusive right to use the software on your own TradingView account. It does not transfer ownership.

You may not share, resell, sublicense, lend, distribute, decompile, reverse engineer, republish or otherwise make our software available to any third party. Sharing access credentials or attempting to redistribute the scripts will result in immediate termination of access without refund.

This website and our communications may contain links to third-party websites. We have no control over their content, policies or practices and accept no responsibility or liability for them. The inclusion of a link does not imply endorsement.

15. Changes to This Disclaimer

We may update this disclaimer from time to time to reflect changes to our products, our practices or applicable law. The version published on this page at any given moment is the version in force. The date at the top indicates the most recent update. Continued use of our website or software after any change constitutes acceptance of the revised terms.

16. Governing Law

This disclaimer and any dispute arising from it are governed by the laws of Spain. Consumers resident in the European Union retain the mandatory protections of the law of their country of residence.
